WeChalet is a secure transactional platform that connects Hosts offering property rentals with Travellers seeking accommodations, while prioritising security and transparency at every step of the transaction.
It is therefore essential to understand that WeChalet is not the owner, manager, real estate broker or travel services agent of the properties listed on our site, and is not a party to contracts entered into directly between Hosts and Travellers.
Rather, the WeChalet platform provides a secure online space for users ("Members") to post, offer, search and book services. Certain parts of the WeChalet platform allow you to provide reviews, text, photos, audio, video, 3D virtual tours, information and other types of content (collectively, the "Content"). Members who post and offer services and Content are "Hosts" and Members who search for, book or use services or Content are "Travellers". Hosts offer accommodations ("Accommodations"), as well as a variety of travel and other services (collectively, the "Host Services," and each Host Service offering, an "Listing").
These Terms and Conditions (the "Terms") are a binding legal contract between you and WeChalet that governs your use of WeChalet's websites, applications and other offerings (referred to, collectively, as the "Platform" or the "WeChalet Platform").
When used in these Terms, the terms "WeChalet", "we", "us" and "our" refer to the Nature WeChalet Inc. entity with which you are contracting, as well as its subsidiaries, agents, representatives, mandataries, employees and directors and Nature WeChalet.
Before transacting on our platform, please read the following terms and conditions carefully. By using our websites (www.wechalet.com, www.wechalet.ca, www.wechalet.fr) and related services , you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please refrain from using our sites and services.
Our mission is to connect people to each other and to nature, to help you appreciate its beauty and importance, and to accelerate the call to protect the Earth that we all share. We also plant a tree for every reservation with the help of One Tree Planted. To learn more about a property, please see the listing description and photos, the Host profile and Traveller comments. If you have any questions about the property, simply send a message to the Host.
As WeChalet is a secure platform, any inducement to make communications or payments outside of our platform represents a direct threat to the integrity of the WeChalet community, exposing you to significant risks of fraud and malicious activity.
In order to ensure the security of payments and transactions, as well as to prevent problems such as phishing, it is strictly forbidden to communicate outside WeChalet before a reservation is paid for and accepted by the Host. In the interests of your own security, we strongly recommend that you always communicate directly on our platform and never provide sensitive information, such as your email, phone number, links to your social networks, personal physical address, links to an external website, or financial details, before confirming a Reservation, to ensure maximum protection.
In order to secure your payments and avoid any type of potential fraud, never accept funds transfers outside the WeChalet site. Unless specifically instructed by the WeChalet team, any payment made via a third-party service or any inducement to book outside our platform may result, at WeChalet's sole discretion, in one or more of the following penalties:
- a) account suspension;
- b) cancellation of all Host Reservations, before or without reimbursement to WeChalet of all sums received by the Host as a result of such cancelled Reservations; and
- c) the cancellation of all of a Traveller's reservations, with or without reimbursement of any sums disbursed by the Traveller upon completion of said cancelled reservations.
WeChalet may display Listings on its website to partner or third-party websites and links to third-party websites, platforms or services (the "Third-Party Websites") that are not owned or controlled by us and are not part of our website. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any Third Party Websites. Opinions expressed or materials appearing on such Third Party Websites are not necessarily shared or endorsed by us and WeChalet should not be considered the publisher of such opinions or materials. We encourage our users to be aware when they leave our site and to read the privacy statements of Third Party Websites.
It is your responsibility to take the necessary measures and precautions to preserve the confidentiality of your personal information when you leave our Website. If you enter into correspondence or transactions with advertisers or partners present on WeChalet, this is your responsibility, and WeChalet cannot secure or be held liable for any statements or actions of third parties, or for any loss or damage arising from such correspondence or transactions or from the presence of advertisers or partners on our Websites.
You are responsible for evaluating the security and reliability of any Third Party Websites linked to or accessible through our platform before disclosing any personal information to them. You acknowledge and agree that WeChalet shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through such Third Party Websites, including where such damage or loss results from your disclosure of personal information to third parties.
General Conditions for Travellers
You can search for accommodation services according to various criteria such as accommodation type, travel destination, dates of stay and number of Travellers. You can also use filters to refine your search results. The relevance of results is determined by factors such as price, geographical location, availability, user reviews, host response speed, cancellation history, popularity, previous experiences of travellers, bookmarked listings, and specific host requirements (e.g. minimum or maximum number of nights). When you book a Host Service, you agree to pay all charges related to the reservation, including the advertised price, applicable fees such as WeChalet service fees, in-person fees, taxes, security deposit fee or damage Protection fee and any other fees indicated at the time of payment for the Reservation (collectively, the "Total Price"). You also agree that WeChalet via WeChalet Nature may charge your Payment Method (as defined in the Payment Terms) used to book the Host Service to collect, where applicable, amounts due under a Damage Claim (as defined in Section 17).
When you receive the reservation confirmation, a contract for Host Services (a "Reservation") is entered into directly between you and the Host. In addition to these Terms, you will be subject to and responsible for complying with all terms and conditions of the Reservation, including, but not limited to, the cancellation policy and any other regulations, standards, policies or requirements identified in the Listing or upon payment that apply to the Reservation. It is your responsibility to read and understand these rules, standards, policies and requirements before Reservation a Host Service. Please be aware that some Hosts work with a co-Host or as part of a team to provide their Host Services.
An Accommodation Reservation grants the Traveller a limited right of access, occupancy and use of the Accommodation, in accordance with these Conditions, the Reservation, applicable laws and the conditions imposed by the Host prior to the Reservation of the Accommodation, including in relation to the time of arrival and departure in the Accommodation and the number of Travellers permitted.
The Host reserves the right to re-enter the Accommodation during your stay, if: (i) this is reasonably necessary and (ii) this is permitted under your Reservation or any applicable law or regulation. If you remain in the Accommodation after the departure time set forth in your Reservation, the Host has the right to (a) require you to leave in accordance with applicable law and (b) charge you a penalty for unduly extended stay and for failure to comply with the terms of the Reservation, in which case the amount shall be determined or determinable in the rules of the Reservation. If you exceed the number of Travellers permitted in the Accommodation in accordance with your Reservation, the Host has the right to charge you (a) an additional amount equivalent to the amount that should have been charged for each such additional unauthorised Traveller and (b) a penalty for non-compliance with the conditions of the Reservation, in which case the amount will be determined or determinable in the rules of the Reservation.
A Reservation that includes a Host Service allows you to participate in, attend or use that Host Service. It is your responsibility to confirm that you and any person you invite meet the minimum age, competence, aptitude or other conditions imposed by the Host prior to booking the Host Service. You are responsible for informing the Host of your state of health or physical condition, or any other circumstance that may impact your ability to participate in, attend or use the Host Service. Except where expressly permitted by WeChalet, you may not allow any person to participate in, attend or use a Host Service unless that person is included as an Additional Traveller under the terms of the Reservation.
You are responsible for your own acts and omissions and those of any person you invite to participate in, attend or use a Host Service or to whom you provide access to an Accommodation as part of a Reservation, regardless of whether that person's name appears on the Reservation or not. For example, this means: (i) that you are responsible for leaving an Accommodation (and associated personal property) in the condition in which you found it when you arrived, (ii) that you are responsible for paying all reasonable damage claims necessary to cover damage caused to an Accommodation by you, your guest(s) or your pet(s), and (iii) that you must act with integrity, treat others with respect and comply with applicable laws, these Terms and other terms of your Reservation at all times. If you make a Reservation that includes an additional Traveller of minor age or if you bring or give access to a minor to an Accommodation or Host Service, you represent that you are legally authorised to act on behalf of such minor and that you are fully responsible for the supervision and actions or omissions of such minor.
You acknowledge that access to and use of the platform and certain activities offered under or accessible via a Reservation involve inherent risks. To the fullest extent permitted by law, you agree to assume all risks arising from (i) your access to and use of the WeChalet platform and the Content (as defined below); (ii) your participation in any Host Service; (iii) your stay in an Accommodation; and (iv) any other interaction you have with other Members, whether in person or online. It is your responsibility to research a Host Service to determine whether it is suitable for you and whether it involves any inherent risks. For example, some Host Services may involve a risk of illness, bodily injury, disability or death, and you freely and voluntarily assume these risks by choosing to participate in such Host Services.
Many Hosts offer basic prices and charge additional fees after a certain number of Travellers or for special services, such as pet fees, boat rentals or firewood fees. As a Traveller, it is your responsibility to create an honest and accurate Reservation request, declaring your true intentions for the rental. To obtain an accurate price for your stay, you must enter the correct actual information in the pricing box located on the WeChalet listing.
We ask you to address all Hosts in a respectful manner. Following a Reservation request, the Host is obliged to reply within 24 hours. In the event of acceptance of the Reservation, if the Host requires additional information to honor your reservation (such as validation of a driver's licence, proof of age, a contract to be signed, etc.), it is your responsibility to provide all necessary documentation in order to facilitate acceptance of the Reservation.
The relationship between Hosts and Travellers is based on trust and mutual willingness to engage in a Reservation. WeChalet acts as a platform facilitating the connection between Hosts and Travellers, but it is up to each Host to accept or refuse a Reservation according to his or her own criteria and availability, within the limits imposed by law. WeChalet cannot be held responsible for the refusal of Reservations by Hosts, and Travellers understand and accept that the decision to accept a Reservation rests entirely with the Host concerned.
It is strictly forbidden to encourage a Host to make a transaction or communicate outside the WeChalet platform before a Reservation has been paid for by the Traveller and accepted by the Host. We reserve the right to suspend your account if such actions are repeated despite our warnings.
Travellers must pay all fees associated with a Reservation through WeChalet and provide a valid payment method when requesting a Reservation, and the Traveller's card will be charged upon payment of the Reservation. Hosts must confirm or decline a Reservation within 24 hours of payment. If the Host does not respond within 24 hours of payment of a Reservation, the Traveller will be automatically refunded by WeChalet.
WeChalet may from time to time offer discount codes in the form of discount coupons and customer service credits ("Promotional Codes"). Promotional Codes are for one-time use only and may not be transferred or shared with others. Each Promotional Code is valid for a limited time and expires on the date indicated in the details of the Promotional Code offer. A Promotional Code has no monetary value, is not for resale and cannot be exchanged for cash or credit. WeChalet reserves the right, at its sole discretion, to discontinue any Promotional Code at any time.
WeChalet may offer gift certificates in the form of promotional codes ("Gift Certificates"). These Gift Certificates are designed for one-time use only and may not be transferred or shared with another person. Each Gift Certificate may be valid for a specific period and may expire on the date specified in the Gift Certificate offer details, depending on the country, province or territory of issue. Gift Certificates have no cash value, cannot be resold and are not redeemable for cash or credit.
As a general rule, as a Traveller, the refund of a cancelled Reservation is governed by the cancellation policies in place at the time of the Reservation. However, in certain circumstances, other policies may prevail and influence the amount of the refund.
In the event of exceptional cancellation due to unforeseen circumstances on the part of the Host, such as the sale of the property, damage in progress, personal reasons, incorrect updating of the calendar, etc., the Traveller will automatically receive a full refund if the Host is no longer able to accommodate him/her. The Traveller expressly acknowledges and agrees that neither WeChalet nor the Host can be held financially responsible for any additional costs or direct or indirect damages arising from such a cancellation.
In the event of cancellation due to an event beyond your control, you may be eligible for a partial or full refund in accordance with our Force Majeure Policy. If the Host cancels or you experience problems during a trip, we can help you rebook or assist you in resolving the issue with the Host. The Traveller expressly acknowledges and agrees that, in such situations, neither WeChalet nor the Host can be held financially responsible for any additional costs or direct or indirect damages arising from the cancellation.
Hosts and Travellers are responsible for any Reservation modifications they agree to make via the WeChalet platform or request WeChalet customer service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated with such a Reservation modification. If a Reservation is refused by the Host or cancelled by the Host, you will be automatically refunded to your original method of payment. Please note that some banks may take up to 5 working days for the refund to appear on your statement.
The service charge payable by the Traveller is calculated on the price per night of a Reservation and includes charges relating to the property, cleaning and other services. These fees vary from 6% to 12% (plus taxes) of the price per night, depending on the length of the stay. The longer the length of stay, i.e. 31 days or more, the lower the fee. WeChalet reserves the right to change service fees at any time, and will inform Members of any fee changes before they take effect.
General Conditions for Hosts
As a Host, WeChalet offers you the right to use the WeChalet platform to offer your Host Services and make them available to our community of Travellers, and to earn income from them. Creating a Listing is very easy. You control how you welcome Travellers, and you set the price, availability and rules for each Listing. By using WeChalet, you represent that you hold all rights necessary to offer your Host Services, including, where applicable, the rights of ownership, representation and exercise of certain reserved activities.
You may create Listings for Host Services that you are legally permitted to rent or offer. Guests book your Host Services based on the information you provide. Consequently, you are responsible for the quality and accuracy of your Listings and you release and hold WeChalet harmless from any claim relating to any inaccuracy or quality defect in your Listings and your Host Services. Make sure all information including features, house rules and available amenities is correct and up to date. Please ensure that the images of your Accommodation or Host Service accurately reflect what Travellers can expect. Please note that you can only manage one Listing per Accommodation or Host Service, but you can have several Listings for the same property if it has several Accommodations.
As a Host, you have complete control over the pricing of your Listings. It is your responsibility to constantly keep prices, minimum stay lengths, where applicable, and availability of your calendar up to date for a recommended period of more than 2 years in advance.
We ask that you address all Travellers in a respectful manner. You are required to respond to Reservation requests within 24 hours of the Traveller's Reservation requests and to confirm or refuse each request within this period. Additionally, as a Host, it is your responsibility to provide all necessary documentation for the Traveller's stay, including arrival and departure information. This helps provide a positive and transparent Reservation experience for all Members of the platform.
The ranking of Listings in search results on the WeChalet platform depends on several factors, including the following main parameters:
- Traveller search parameters (e.g. number of Travellers, date and duration of trip, price range, geographic location of the Accommodation or Host Service searched)
- Characteristics of the Listing (e.g. price, calendar availability, number and quality of images, Reviews, type of Host Service, status of the Host, age of the Listing, average popularity among Travellers)
- Reservation experience offered by the Host to Travellers (for example, the Host's history of cancellations and use of user support, ease of reservation)
- Host Requirements (e.g. minimum or maximum number of nights, reservation cut-off time)
- Traveller Preferences (e.g. previous trips, Saved Listings, location from which the Traveller is searching)
Search results may appear different on our mobile app and on our website. WeChalet may allow Hosts to promote their Listings in search results or outside of the WeChalet platform for an additional fee. You can find more information about the factors that determine your Listing's search ranking, our current promotion programs (if applicable), and how we identify promoted content in our Help Center.
As a Host, you have the right to accept or decline a Reservation based on your criteria and availability, subject to applicable laws. WeChalet acts as a platform facilitating the connection of Hosts and Travellers, but the decision to accept or refuse a Reservation rests exclusively with you. Rest assured that your freedom of choice is respected. Travellers understand and agree that the decision to accept a Reservation rests entirely with the Host concerned.
You acknowledge that hosting Travellers involves inherent risks and you agree to assume all risks arising from (i) your access to and use of the WeChalet platform, (ii) your offering of Host Services and ( iii) any other interactions you have with other Members whether in person or online. You acknowledge that you have had the opportunity to study the WeChalet platform and all laws, rules, regulations or obligations that may apply to your Listing and your Host Services. You acknowledge that you are not relying on any statement of law made by WeChalet.
When you accept a Reservation request or receive a Reservation confirmation on the WeChalet platform, you are entering into a contract directly with the Traveller and you are responsible for delivering the Host Service according to the terms and prices specified in your Listing. You also agree to pay applicable fees such as WeChalet service fees (and applicable taxes) for each Reservation. WeChalet Nature will deduct amounts due from your payment, unless you and WeChalet have agreed in writing to another method. Any terms, policies or terms that you include in an additional contract with Guests must: (i) comply with these Terms, our policies and the information provided in your Listing, and (ii) be clearly and conspicuously disclosed in the description of your Listing, before payment of the Reservation by the Traveller.
Your relationship with WeChalet is that of an individual or independent entity and not that of an employee, agent, joint venturer or partner of WeChalet, except that WeChalet Nature may act as a payment collection agent as needed. WeChalet does not direct or control your Host Services, and you agree that the decision of when and how to offer Host Services, and at what price and on what terms is at your sole discretion and responsibility.
If you work with a co-Host or other member of a team, company or other organisation, the entity and each individual who participates in providing the Host Services are responsible as Host under these Terms. If you agree to the Terms or enter into contracts, you represent and warrant that you are authorised to enter into contracts for your team, business or other organisation and that each entity you use complies with the laws of the place in which it is established . If you perform other functions, you represent and warrant that you have received authorization to perform these functions. You are responsible for payment amounts and the accuracy of the information you provide.
Within the first 24 hours of arrival, in the event of any Problems encountered during a trip (as defined below), Travellers may contact WeChalet by email for appropriate assistance and, if necessary, we may compensate them financially during this period. To guarantee Traveller satisfaction and protect their payments, the Host will therefore receive their payment 24 hours after the Travellers' arrival. This period allows the Traveller to check the quality and compliance of the Accommodation and/or Host Services with the information provided by the Host in their Listing.
The term “Problems Encountered While Travelling” covers the following situations:
The Host cancels the Reservation before the Traveller's arrival or during their stay.
The Host does not provide the Host Services or access to the Accommodation in accordance with the Reservation.
The Host fails to indicate in the listing that the Host, another person or a pet will be present on site during the stay or activity.
The Accommodation is not habitable upon arrival for one of the following reasons:
- It is not reasonably clean, including the bedding and towels.
- It poses safety or health risks.
- It is home to harmful animals.
The Listing contains a material inaccuracy, including, but not limited to:
- The accommodation type is incorrect (for example, entire accommodation, private room, or shared room).
- The type or number of rooms is incorrect (for example, bedrooms, bathrooms and kitchens).
- The location of the Accommodation is incorrect.
- A specific equipment or feature described in the ad is missing or does not work. For example, swimming pool, jacuzzi, bathroom (toilet, shower or bathtub), kitchen (sink, stove, refrigerator or other household appliance), electrical, heating or air conditioning systems.
- Photos in the Listing do not accurately represent the Accommodation or Host Service or are misleading.
- The Host Service does not match the description in the Listing
In the event of Problems encountered during a trip, the Traveller must, if possible, inform the Host and try to resolve the problem directly with them.
If a refund to the Traveller must be made, it depends on the seriousness of the problem encountered during the trip, its impact on the Traveller, the portion of the stay concerned, and the Traveller's decision to leave the Accommodation or not .
In the case of a partial refund, the Host will have their payment reduced by the amount refunded to the Traveller. If the Traveller chooses to leave due to the problem encountered during the trip and notifies us, we will have to refund the Traveller in full. This means that the Host will not receive any payment for the problematic Reservation. The Host will remain responsible for paying applicable fees such as WeChalet service fees (and applicable taxes) for each Reservation affected by a Problem encountered during a trip.
In most cases, we will attempt to confirm a Guest's claim with their Host. Hosts can also dispute a Problem encountered during the trip by contacting us.
Please note that outside of the WeChalet platform, you cannot charge additional fees, except those expressly permitted by our In-Person Fees Policy.
WeChalet offers Hosts the option to request a security deposit, which is at the discretion of the Host. If the Host chooses not to set a security deposit, WeChalet reserves the right to charge an automated security deposit to protect the Host in the event of minor damages during a Reservation.
At this time, WeChalet does not offer Reservation insurance to Travellers. Although the validation of insurance is not the responsibility of WeChalet, all owners, whether short-term or long-term rentals, must legally have property and civil liability insurance. a minimum of 2 million dollars, permanently, when publishing your listing.
As a Host, it is imperative that you understand and comply with all laws, regulations and third party agreements that apply to your Listing or Host Services. This includes considerations such as short-term rental restrictions, zoning laws, Host registration, and other area-specific requirements. Some locations have specific regulations on subletting, short-term rentals, or long-term stays. Some jurisdictions may require specific registrations or licences for certain Host services such as the preparation of food, the sale of alcohol, guided tours, or the use of vehicles.
You are also responsible for processing Travellers' personal data in compliance with privacy laws and these Terms. The information provided by WeChalet regarding legal requirements is informative, but you should independently verify your obligations. For specific advice on how local laws apply to your services, we recommend that you consult legal counsel.
Generally, if a Traveller cancels a Reservation, the amount you receive is determined by the cancellation policy applicable to that Reservation. As a Host, you must not cancel a Guest's Reservation unless for a reason provided for in our Force Majeure Policy or applicable law. If you cancel a Traveller's Reservation without such valid reason, WeChalet reserves the right to impose cancellation fees and other consequences. If: (i) a Traveller suffers a Problem encountered during a trip, (ii) a force majeure event occurs, or (iii) a Reservation is cancelled under these Conditions, the amount refunded or granted another manner to the Traveller, as well as any other costs incurred by WeChalet due to the cancellation, will be deducted from the amount paid to the Host. If a Traveller receives a refund for a Reservation and you have already received your payment for that Reservation, or if the amount of the refund and other costs incurred by WeChalet exceeds your payment, WeChalet (via WeChalet Nature) may recover this additional excess amount from you, including by deducting the reimbursement from your future payments. By using the Platform and offering Host Services, you agree to the Force Majeure Policy , and these Terms take precedence over any cancellation terms you have established in situations where these Terms permit cancellation of a reservation and/or reimbursement of Travellers. If WeChalet reasonably provides for a refund to a Traveller under one of its policies, we may withhold any payment for that Reservation until a refund decision is made by WeChalet. Under no circumstances will WeChalet be held liable due to such late payment, including, but not limited to, for any direct or indirect damage suffered by the Host due to the late payment.
Hosts and Guests are responsible for any changes to a Reservation that they agree to make via the WeChalet platform or that they request WeChalet customer service to make on their behalf, and they agree to pay any additional amounts, fees or taxes associated with such modification of Reservation. As a Host on WeChalet, you are responsible for keeping Listings up to date to ensure Traveller trust and satisfaction. Frequent cancellations or repeated refusals related to outdated information in your Listings may impact the Traveller experience. WeChalet reserves the right to suspend one or more Listings from a Host in the event of excessive or unjustified cancellations or refusals, thus compromising the reliability of the platform and the Member experience. Our team is available at any time to support you throughout the Reservation and Listing creation process if necessary, subject to our opening hours.
The publication of Listings on our platform is free. The rates you quote in your listing must include all Reservation fees, including but not limited to Host service fees, administrative fees, platform fees, deposit amount if applicable and applicable taxes. We use a third-party processor for Traveller payments. The Host Services Fee of 3% (plus applicable taxes) covers administrative services related to payments. WeChalet reserves the right to change the Service Fees at any time, and will notify Members of any fee changes before they become effective.
As a Host, you are required to comply with applicable laws by declaring, collecting, remitting or including in your rates any value added tax (VAT) or other indirect taxes, tourist taxes, tourist taxes, income taxes or other applicable taxes (“Taxes”).
Where WeChalet facilitates the collection and/or remitting of Taxes on behalf of Hosts, you authorise WeChalet to collect Taxes on your behalf and/or remit them to the appropriate taxing authority. Taxes collected and/or remitted by WeChalet are clearly indicated in Members' transaction records. In the event of insufficient Taxes collected and/or remitted, WeChalet may request additional amounts from Members, with your agreement that the only remedy for Taxes collected by WeChalet is a refund issued by the tax authority.
In some jurisdictions, tax regulations may require WeChalet to collect and/or report tax information about you. If you fail to provide the necessary documentation for these purposes, WeChalet may withhold payments due to you until the appropriate documentation is obtained. You consent to WeChalet issuing invoices or similar documents for Taxes, thereby facilitating accurate tax reporting.
Regarding the Quebec Sales Tax Act, WeChalet service fees are subject to this tax. Details of taxes collected are available on the invoice associated with each Reservation.
General Terms and conditions
WeChalet will shortly allow the publication of reviews on a Listing following a stay by a Traveller. Until then, these reviews come from other platforms where the Listings are displayed. Please note that these reviews are not verified for accuracy by WeChalet and may be false, incorrect, or misleading.
WeChalet offers Hosts the flexibility to choose one of our cancellation policies designed to protect both Travellers and Hosts. Each Listing and Reservation on our platform clearly indicates the cancellation policy selected by the Host for Travellers (the “Listing Cancellation Policy”). Travellers are required to carefully read and understand the Listing Cancellation Policy before submitting a Reservation request and making payment. By paying for a Reservation, Travellers de facto accept the Listing's Cancellation Policy.
In the event of cancellation of the Reservation, the Traveller's refund will be processed in accordance with the Listing's Cancellation Policy. WeChalet reserves the right to modify its cancellation policies at any time, and any modification will be clearly communicated on the listing and to Members when it comes into effect.
Under no circumstances will a Member be able to initiate legal proceedings or claims against WeChalet in connection with the Listing Cancellation Policy. Use of our platform implies the express acceptance and commitment of each Member to respect the Listing Cancellation Policy and any applicable WeChalet cancellation policy, and any dispute over cancellation or refund must be resolved between the Host and the Traveller, in accordance with the procedure described in the Listing Cancellation Policy.
If a Host provides WeChalet with valid proof that you, your Travellers, your pets or any other person to whom you have provided access to a Host Service have caused damage during a Reservation to their movable, real or personal or property of others, including consequential damages (a “Damage Claim”), WeChalet will be responsible for handling the Damage Claim and any disputes arising therefrom.
To make a request to seize the security deposit, the Host must contact our support team via the chat bubble at the bottom of our website or by email within 7 days of the Travellers' departure. We strongly recommend to communicate in advance with the Traveller to inform them of your intention to partially or completely recover the Traveller's security deposit.
The Host must ensure that they provide us with the following elements:
- Comprehensive documentation and associated costs for repairing damage.
- Clear photographs illustrating the damage.
- Detailed descriptions, age and replacement costs of affected items.
- Original invoices, professional repair quotes, and/or links to replacement items online.
- Proof of prior communication with the Traveller regarding the damage.
You have a maximum period of 7 days following the filing of the Damage Claim to send us this information if you wish to make a request for seizure of the Traveller's security deposit.
WeChalet is committed to maintaining a fair and equitable complaints process for all of our Members. When a Damage Claim is submitted, we take care to contact both the Host and the Traveller to obtain both versions of the facts, if applicable.
Compensation for damaged goods takes into account the age of the good and its commercial use. Thus, no new replacement value is granted for goods used commercially for several years. This process is based on optimising the depreciation of a good due to normal wear and tear associated with commercial use during rentals. It highlights the responsibility of the Host in the preventive maintenance of their goods and aims to provide fair and reasonable compensation for all.
After a thorough analysis, if both parties cannot reach an agreement, we will make a decision based on the documentation provided, the age of the damaged goods, the arguments of both parties and our experience in handling Damage Claims.
Since each Host has the freedom to set the amount of their security deposit based on their own criteria, the Claim for damages addressed to WeChalet cannot under any circumstances exceed the amount of the security deposit established by the Host. If applicable, any claim for the excess portion of the security deposit must be filed with the Host’s insurer.
When making a Reservation, the Traveller has the option to pay the full amount of the security deposit or choose to pay a damage protection fee, thereby covering the maximum amount of the security deposit in the event of damage during the stay. In this case, in no case may any Claim for damages from a Host exceed the amount of the security deposit established by the Host.
Only damage caused during a stay can be claimed during a security deposit seizure. Any claim for costs not related to damage, including, but not limited to, any claim for additional costs related to the stay, fees for additional Guests, fees for special services, fees related to an arrival early or late departure, etc., will be refused in the context of a Claim for damages; the Host must claim these costs directly from the Traveller.
Any claims for additional fees deemed excessive, at WeChalet's discretion, including, but not limited to, fine fees, administrative fees, communication fees, processing fees, and shipping service fees WeChalet will, at WeChalet's discretion, refuse or reduce.
In the event of intentional, deliberate or willful damage, gross negligence or willful misconduct by the Traveller, at WeChalet's sole discretion, we may determine that the Traveller is liable for the damages alleged by the Host, and WeChalet, via WeChalet Nature, may recover the amount of the Damage Claim from the Traveller or any insurance. You agree that WeChalet will collect the amount of the Damage Claim from any insurance you carry, and take other actions in accordance with any applicable law, including using a collection agency, initiating legal proceedings and/or claiming amounts owed directly against you. You agree to cooperate honestly, provide all information requested by WeChalet, sign documents and take reasonable actions related to Damage Claims and their enforcement, Member complaints, insurance claims or other claims relating to your provision or use of the Host Services.
Under no circumstances may a Member, whether a Host or Traveller, bring any action or claim against WeChalet, its affiliates, directors, employees, contractors and agents (collectively, the “WeChalet Parties”) or against the one of the parties involved in the Reservation, whether in connection with a dispute resolution, a security deposit claim, or any other aspect of the process relating to the Reservation. By agreeing to use our platform and services, you waive any right of legal action against the WeChalet Parties. This waiver covers all stages of the Reservation process, including Host Damage Claims, and is intended to promote fair resolution of disputes in accordance with our internal procedures.
The WeChalet Platform and all content are provided “as is” without legal warranty or guarantee of any kind. WeChalet disclaims all warranties, express or implied. For example: (i) WeChalet does not endorse or guarantee the existence, conduct, performance, safety, quality, legality or suitability of any Traveller, Host, Host Service, Listing, Hosting or third parties, (ii) WeChalet does not guarantee the performance or non-interruption of the WeChalet platform, and (iii) WeChalet does not guarantee that the checks and identity or background checks carried out on the Listings or Members (if applicable) will identify past misconduct or prevent future misconduct. Any reference to a “verified” Member or Listing (or any similar term) means only that the Member or Listing or WeChalet has been subject to an online verification or identification procedure, but nothing 'other. The disclaimers in these Terms and Conditions apply to the fullest extent permitted by law. If you have statutory rights or warranties that WeChalet cannot exclude, the duration of those statutory rights or warranties will be limited to the fullest extent permitted by law.
You expressly agree that WeChalet will not be liable for any loss or damage incurred by you or any other party arising from these Terms and your use of the Platform.
You acknowledge and agree that you will be solely responsible for all damages, claims or allegations arising directly or indirectly from the Platform and that you will hold WeChalet harmless and indemnified from all such damages, claims or allegations. Furthermore, WeChalet shall not be liable for any claims or damages resulting from any negligence, misconduct or misrepresentation on your part. Furthermore, you expressly waive any rights and benefits you may have under any state or federal statute or common law principle of similar effect, to the fullest extent permitted by law.
Under no circumstances will WeChalet and any other party involved in the creation, production or operation of the WeChalet Platform be liable to you or to any third party for any direct or indirect, incidental, consequential, punitive or exemplary damages arising from the subject matter of these Terms, including lost profits, lost data, lost goodwill, service interruptions, computer damage, system failures and the cost of substitute products or services, or any damages for personal injury or bodily injury or emotional distress arising out of or in connection with (i) these Terms and Conditions, (ii) the use of or inability to use or access the WeChalet Platform or its Content, ( iii) the quality and security of the WeChalet platform and its Content (iv) any communication, interaction or meeting you may have with anyone with whom you interact or meet through, or arising from, your use of the WeChalet platform, or (v) posting or viewing a Listing, Reservation, providing or using a Host Service, even if you or WeChalet has been informed of the possibility of such damages and even if a limited remedy provided for in these General Conditions proves to have failed of its essential purpose.
Except for our obligation to make payments to Hosts under these Terms and Conditions or to make payments under WeChalet Host Damage Protection, in no event shall WeChalet be aggregated liable for any claim or dispute arising of or in connection with these Terms and Conditions, your interaction with any Member, or your use of or inability to use the WeChalet platform, any content or any Host Services, will not exceed: (A) for Guests, the amount paid as as a Guest during the 12 month period preceding the liability event, (B) for Hosts, the amount paid as a Host during the 12 month period preceding the liability event, or (C) for any other person, one hundred Canadian dollars ($100 CAN).
These limitations of liability and damages are essential elements of the contract between you and WeChalet. You hereby acknowledge and agree that the limitations contained in this clause are reasonable in light of all the circumstances. If applicable law does not permit one or more of the limitations of liability set forth in these Terms and Conditions, the specifically inapplicable limitation(s) may not apply to you, without affecting the validity and enforceability of the other limitations of liability contained therein.
Your sole and exclusive remedy for dissatisfaction is to discontinue using the WeChalet Website or Services.
To the fullest extent permitted by applicable law, you agree to release, defend (at WeChalet's option), indemnify and hold WeChalet (including its affiliates and their personnel) harmless from any claims, liability , damages, harm, damage, loss and expense of any nature including, but not limited to, reasonable legal and accounting fees, arising out of or in connection with: (i) your failure to comply with these Terms ( including any additional or additional terms that apply to a product or functionality of the platform), (ii) your inappropriate or illegal use of the WeChalet platform, (iii) your interaction with any Member, your stay in an Accommodation and your participation, use or provision of a Host Service, (iv) your failure, or our failure following your instructions, to accurately report, collect or remit applicable taxes, or (v) your violation of any law, regulatory or third party rights, including, but not limited to, intellectual property and privacy rights.
WeChalet grants you the right to use our platform which allows Members to post, offer, search and book Listings and Host Services. Although we make every effort to ensure excellent experiences with WeChalet, we cannot exercise absolute control over the behavior of Travellers and Hosts. You acknowledge that WeChalet has the right, but has no obligation, to monitor the use of its platform and verify the information provided by Members. This may include verifying Content shared or posted by a Member, deactivating a Member's access to the platform, deleting or modifying a Listing, information or a Member's account for the Member. one of the following reasons: (i) operation, security, maintenance, compliance and improvement of the WeChalet platform (including fraud prevention, risk assessment, investigation and user support); (ii) ensuring Member compliance with our Terms of Use; (iii) compliance with applicable law, orders or requirements of courts, law enforcement, or other administrative or governmental agencies; (iv) processing Content that we deem to be harmful, objectionable, or in violation of our Terms of Use and policies; (v) enforcement of the measures set out in our Terms of Use; and (vi) maintaining and applying any quality or eligibility criteria, including the removal of Listings that do not meet these criteria. Members acknowledge and agree that WeChalet manages and modifies its additional terms of use, policies (such as our Force Majeure Policy) and standards (such as the basic criteria for Hosts) in its sole discretion, including decisions about whether and how to apply them to a particular situation. Members agree to cooperate in good faith with WeChalet, providing information and taking actions reasonably requested in connection with any investigation conducted by WeChalet regarding the use or abuse of its platform. WeChalet does not act as a representative of any Member, except where WeChalet Nature acts as a collection agent in accordance with our Payment Terms.
We allow you to browse our sites for free without registration. However, to access and use the features of the WeChalet platform, you must create an account.
Registration is limited to (a) legal entities, partnerships and individuals aged 18 or over, (b) who can enter into a binding contract with WeChalet, and (c) only in accordance with these Terms and all applicable laws, rules and regulations. By registering, you confirm that you are not an entity or person prohibited from using the WeChalet platform under Canadian laws or any other applicable jurisdiction. You must provide accurate, current and complete information when registering, and keep your account updated. Unauthorised users are strictly prohibited from directly or indirectly accessing or attempting to access the Platform. Any such unauthorised use is strictly prohibited and constitutes a violation of these Terms and applicable laws. Creating multiple accounts and transferring your account to others without first obtaining approval from WeChalet is prohibited. You are responsible for maintaining the confidentiality of your account credentials and must not disclose them to third parties. You must immediately notify WeChalet if you suspect loss, theft or compromise of your credentials. In compliance with applicable laws, WeChalet reserves the right to request identification, conduct identity verifications, compare your information to third-party databases, obtain reports of criminal convictions or other relevant information as necessary, and you agree to cooperate fully with WeChalet in such efforts.
WeChalet reserves the right to accept or refuse the creation of an account by a Member at any time and for any reason. For reasons deemed appropriate by WeChalet, we reserve the right to terminate this contract, restrict your access to all or part of the platform or Services at any time, without notice or liability. This authority also includes the right to cancel any reservation, without notice, without liability to us.
By accessing the Platform, you acknowledge these rules and you undertake to respect them and not to help or encourage others to violate or circumvent them.
Act with integrity and treat others with respect.
- Do not lie, misrepresent something or someone, or pretend to be someone else.
- Show politeness and respect when communicating or interacting with others.
- Comply with our Non-Discrimination Policy and do not discriminate or harass others.
Do not data harvest, hack, reverse engineer, compromise or alter the WeChalet Platform or Platform user data.
- Do not use bots, crawlers, scrapers or other automatic means to access, scrape or otherwise interact with data or other Content from the WeChalet Platform.
- You must not hack, avoid, delete, alter or attempt to circumvent any security or technological measures used to protect the platform or the Content.
- You shall not decipher, decompile, disassemble or reverse engineer any software or any hardware used to provide the WeChalet Platform.
- You must not take any actions that could damage or negatively affect the performance or proper functioning of the WeChalet platform.
Use the WeChalet Platform only as permitted by these Terms or another contract with us.
- You may only use another Member's personal information when required to facilitate a transaction through the WeChalet Platform, as permitted by these Terms, and at all times in compliance with applicable laws and regulations.
- You may not use the WeChalet platform, our messaging tools, or Members' personal information to send commercial messages without the explicit consent of the recipient.
- You may only use content available on the WeChalet platform if necessary to enable you to use the WeChalet platform as a Guest or Host, and in any case for lawful purposes.
- You must not use the Platform Content unless you have permission from the owner of that content or use is authorised by us in these Terms or in another agreement with WeChalet.
- You must not request, make or accept a Reservation or payment outside of the WeChalet platform to avoid paying fees, taxes or for any other reason. See our In-Person Fee Policy for exceptions.
- You must not require or encourage Travellers to open an account, leave a review, respond to a survey or otherwise interact with any third party website, application or service for these purposes before, during or after a Reservation, unless authorised by WeChalet.
- You must not engage in any operations intended to manipulate our search algorithm.
- You should not book Host Services unless you actually use those services.
- You must not use, copy, display or frame the WeChalet Platform, its content, any WeChalet trademarks, or any layout or design without our consent.
Comply with your legal obligations.
- Understand and comply with the laws that apply to you, including privacy, data protection and export laws.
- If you provide us with personal information about another person: (i) you must do so in accordance with applicable law, (ii) you must have received authorization to do so and you represent that you have received such authorization, and (iii) you authorise us to process this information under our privacy policies.
- Read and comply with these Terms and Conditions, as well as all additional legal terms, policies and standards available on our website.
- Do not organise or host unauthorised parties or events. You are responsible for any party or event during your Reservation that violates our Party and Event Rules, as attached by reference herein.
- Do not use the name, logo, brand or registered trademarks of WeChalet without authorization, and only as indicated in our instructions on the use of registered trademarks in article 28 below.
- You must not use or register any domain name, social media handle, trade name, trademark, logo or other source identifier that could be confused with the WeChalet brand.
- You must not offer Host Services that violate any laws or contracts that concern you.
- You must not offer or solicit prostitution services or participate in or facilitate human trafficking.
If you believe that a Member, Listing or Content poses an imminent risk of harm or damage to any person or Accommodation, you should immediately contact local authorities before contacting WeChalet. Additionally, if you believe that a Member, Listing or Content violates our values, expectations or these Terms, you should raise your concerns with WeChalet. If you have reported a problem to local authorities, WeChalet may request a copy of this report. Except as required by law, you agree that we are not required to take action in response to a report.
If you believe that any Content on the WeChalet Platform infringes copyright or any other intellectual property right, please notify us immediately.
By providing Content, in any form and by any means, you grant WeChalet a non-exclusive, worldwide, royalty-free, irrevocable, perpetual, sublicensable, transferable licence to copy, modify, prepare derivative works of, distribute, publish and otherwise exploit such Content, without limitation. If the Content includes personal information, our Privacy Policy describes how we use that personal information.
Where WeChalet pays for the creation of Content or facilitates its creation, WeChalet may own that Content, in which case additional terms or disclosures will make this clear. You are entirely responsible for all Content that you provide and warrant that you own it or have authorization to grant WeChalet the rights described in these Terms. You are responsible if any part of your Content infringes or infringes the intellectual property or privacy rights of WeChalet or any third party.
Content must comply with our non-discrimination values, which prohibit, among other things, discriminatory, obscene, harassing, deceptive, violent and unlawful content. You agree that WeChalet may use and offer automated services or tools to translate Content and that your Content may be translated using such services or tools. WeChalet does not guarantee the accuracy or quality of translations and Members are responsible for confirming the accuracy of such translations.
The contract between you and WeChalet that these Terms reflect, begins when you access the WeChalet platform (for example to create an account) and remains in force until either you or we terminate the contract in accordance with these Terms.
You may terminate this agreement at any time by emailing us at our Support Department or deleting your account. WeChalet may terminate this Agreement and your account for any reason without notice either by email or using any other contact information you have provided in your account. WeChalet may also terminate this agreement immediately and without notice and cease providing access to the WeChalet Platform if you violate these Terms, our policies and standards available on our website or applicable laws, or if we reasonably believe that termination is necessary to protect WeChalet, its Members or third parties. If your account has been inactive for more than two years, we may terminate your account without any notice.
If (i) you violate these Terms, our policies and standards available on our website, (ii) you violate any applicable laws, regulations or third party rights, or (iii) WeChalet believes it is reasonably necessary to protect WeChalet, its Members or third parties, WeChalet may, with or without prior notification:
- suspend or limit your access and use of the WeChalet platform and/or your account;
- suspend or remove Listings, reviews or other Content;
- cancel current or confirmed Reservations; And
- suspend or revoke any special status associated with your account.
For minor violations or where appropriate, and as WeChalet determines in its sole discretion, you will be informed of any action WeChalet considers and will be given the opportunity to resolve the issue. You may appeal actions we have taken under this section by contacting customer service. If a Reservation is cancelled under this section, the amount refunded or otherwise awarded to the Guest or Host, as applicable, together with any other costs incurred by us due to the cancellation, will be , as the case may be, deducted from the amount paid to the Host or invoiced to the Host or the Traveller.
WeChalet may take any action it reasonably deems necessary to comply with applicable law, or the order or request of a court, law enforcement agency, other administrative agency or of a government agency.
If you are a Host and cancel your WeChalet account, all confirmed Reservations will be automatically cancelled and Guests will receive a full refund. If you delete your WeChalet account as a Traveller, all confirmed Reservations will be automatically cancelled and any refund will depend on the Listing's cancellation policy. In the event of termination of this agreement, you are not entitled to a restoration of your account or your Content. If your access to or use of the WeChalet Platform has been restricted, if your WeChalet account has been suspended, or if this agreement has been terminated by us, you may not register a new account or access the WeChalet Platform or the 'use with another Member's account.
Those portions of these Terms which by their nature survive termination shall survive termination of this agreement.
When you use the WeChalet Platform, we may collect, hold and use personal information.
The personal data and information collected may include geolocation information, usage information, log data and device information, payment transaction information and personal information, as more fully detailed below. below (collectively, the “Data”).
This includes precise or approximate location determined from your IP address or your mobile device's GPS based on your device settings. We may also collect this information even if you do not use the app, if you enable it through your settings or device permissions.
This includes the pages or content you view, ad searches, Reservations you have made and other actions on the WeChalet platform.
This includes details of how you used the WeChalet Platform (including whether you clicked on links to third-party applications), IP address, dates and times of access, hardware information and software, information about the device used to access the Platform, device event information, unique identifiers, crash data, cookie data and the pages you viewed or interacted with. are engaged before or after using the WeChalet platform. We may collect this information even if you have not created a WeChalet account or are not logged in.
This includes the payment instrument used, date and time, payment amount, payment instrument expiration date and billing zip code, PayPal email address, IBAN information , your address and other associated transaction details.
This includes personal information that you provide to us when creating your account, such as your first name, last name, address, email address, date of birth, etc.
The Data collected by the WeChalet platform may be used to:
a) Providing our Services, including updating, securing, troubleshooting, and providing support; this also includes sharing data, where necessary for the provision of the Services or to carry out the transactions you request;
b) Carry out our activities, including to analyse our performance, comply with our legal obligations, develop our workforce and conduct research;
c) Offer you personalised Services and recommendations;
d) Send you advertising and marketing communications, which includes sending you promotional communications, targeted Listings and presentations of offers that may be of interest to you; And
e) Improve and develop the WeChalet platform and our Services.
WeChalet anonymizes Retained Data by deleting the entire IP address after 12 months of inactivity and cookie IDs and other session identifiers used to identify a specific account or device after 24 months of inactivity.
WeChalet will maintain reasonable and appropriate organisational and technical security measures to protect against unauthorised or accidental access, loss, alteration, disclosure or destruction of the Data and to protect the rights of individuals to whom such Data relates.
By using the platform, you expressly consent to the collection, holding and use of the Data in accordance with the terms hereof, and you grant WeChalet a perpetual, irrevocable, free and non-exclusive licence authorising the collection, holding and use the Data for the purposes mentioned herein, as well as for any related or legal purpose, subject to your rights of access and portability to the Data, rectification of the Data, forgetting and opposition, limitation of the processing of Data and withdrawal of your consent, in accordance with our confidentiality rules (point 30).
In some regions, the law expressly gives you the right to request deletion of your personal information. Please note that if you request deletion of your personal information, the provisions of this section will apply.
We may retain your personal information where necessary for our legitimate tax interests, such as preventing money laundering, detecting and preventing fraud, and improving security. For example, if we suspend a WeChalet account for fraud or security reasons, we may retain that account information to prevent that member from opening a new WeChalet account in the future.
We may retain and use your personal information to the extent necessary to comply with our legal and tax obligations. For example, we may retain information about paid reservations for tax, legal and auditing obligations.
Information that you have shared with other members (for example, reviews of your stay or about a Guest) will continue to be publicly visible on WeChalet, even after your WeChalet account is terminated. However, the attribution of this information to you will be deleted.
Some copies of your information (for example, log records) may remain in our database, but will be dissociated from personal identifiers. Because we take steps to protect data against accidental or malicious loss and destruction, residual copies of your personal information may not be deleted from our backup systems for a limited period of time.
WeChalet owns proprietary rights to certain registered and unregistered trademarks, service marks and logos (collectively, the “WeChalet Trademarks”). Nothing on this site suggests that you have any right to use our WeChalet Marks without our specific written permission on each occasion. Product names, services, and logos used or displayed on this Site may also be trademarks or service marks of their respective owners, who may or may not be affiliated with WeChalet. Other trademarks on the Site remain the property of their respective owners, and their use does not necessarily imply affiliation with or endorsement by WeChalet.
WeChalet may modify these Terms at any time. If we change any material aspect of these Terms, we will post the revised Terms on the WeChalet Platform and change the “last updated” date at the beginning of these Terms. We will also send you any significant changes by email no later than 30 days following their effective date. If you do not agree to the revised Terms, you may immediately terminate this agreement as provided for in these Terms. If you do not terminate your agreement before the date the revised Terms become effective and you continue to access or use the WeChalet Platform, this constitutes acceptance of the revised Terms.
If you have access to confidential information of WeChalet, its affiliates and other third parties, you agree to use such confidential information only as necessary to use the platform in accordance with these Terms. You may not disclose the Confidential Information to any third party and you will protect the Confidential Information in the same manner as you protect your own confidential information of a similar nature, using at least a reasonable level of care. Confidential Information means non-public information that WeChalet, our affiliates or third parties designate as confidential or which should reasonably be considered confidential under the circumstances, including algorithms, software, specifications and other business information. non-public.
You must implement reasonable and appropriate measures designed to help secure your access to and use of the Platform. If you discover any vulnerabilities or breaches relating to your use of the Platform or your account, you must promptly contact WeChalet by email and provide details of the vulnerability or breach.
If you use the Platform to process data or personal information of third party individuals, you must provide legally adequate privacy notices to such third party individuals and obtain necessary consents from such third party individuals for the processing of their data in and through the Platform. Platform, and you hereby declare to process this data in accordance with applicable laws.
If any article, paragraph or section of these Terms is found to be unenforceable, that will not affect any other article, paragraph or section. If you fail to comply with these Terms, and WeChalet does not act immediately, you acknowledge that WeChalet does not waive any rights or actions it may have.
